A class-action lawsuit filed against Delta Dental alleges the insurer misrepresents its out-of-network coverage.
Filed Dec. 31, 2025, in the U.S. District Court for the Southern District of New York, the lawsuit claims Delta Dental covers less than its advertised rates for out-of-network dental care.
Plaintiffs say the company tells policyholders it will cover 50% to 100% of out-of-network costs, but reimbursement is calculated using an internal price set by the insurer, not the provider’s fee.
The plaintiffs also allege that Delta Dental refuses to disclose its internal pricing, even when customers request it. This practice makes it difficult for patients to predict how much they will ultimately owe for out-of-network treatment.
The lawsuit names Delta Dental Plans Association and its affiliates as defendants. Those served are required to respond to the complaint by April 7.
